§129 — Insurance

適合性評価機関は、賠償責任保険に加入しなければならない。ただし、
Conformity assessment bodies shall take out liability insurance unless liability is assumed by the
国内法に従い加盟国が賠償責任を負う場合、又は加盟国自身が適合性評価について直接責任を負う場合は、この限りでない。
State in accordance with national law or the Member State itself is directly responsible for the conformity assessment.
ノーティファイドボディは、加盟国の国内法令の下で賠償責任が保証されている場合を除き、その適合性評価活動及び専門的活動を対象とする適切な保険を有しなければならない。賠償責任保険の範囲及び全体的な金額は、ノーティファイドボディの活動の水準に見合ったものでなければならない。ただし、適合性評価の一部の段階がノーティファイドボディの責任の下で実施される場合であっても、特に経済事業者（製造業者、設置者、販売業者、輸入業者及び認定代理人）は、昇降機用安全部品又は昇降機の昇降機指令のすべての要件への適合について全体的な責任を負い続ける。
Notified bodies must have adequate insurance to cover their conformity assessment activities and professional activities, unless liability is assured under the national legislation of the Member State. The scope and overall financial value of liability insurance must correspond to the level of activity of the notified body. The economic operators (manufacturer, installer, distributor, importer and authorised reprensative) in particular retain, however, the overall responsibility for the conformity of a safety component for lifts or a lift with all the requirements of the Lifts Directive, even if some stages of the conformity assessment are carried out under the responsibility of a notified body.
10. 適合性評価機関の職員は、その活動が行われる加盟国の所管当局に対する場合を除き、附属書IVからXIIまで又はこれを実施する国内法の規定に基づく業務の遂行に当たり得たすべての情報について、職業上の守秘義務を遵守しなければならない。財産権は、保護されなければならない。
The personnel of a conformity assessment body shall observe professional secrecy with regard to all information obtained in carrying out their tasks under Annexes IV to XII or any provision of national law giving effect to it, except in relation to the competent authorities of the Member State in which its activities are carried out. Proprietary rights shall be protected.
