EU域外の製造業者は、認定代理人を通じて当局への対応窓口をEU域内に置くことができます。委任状に記載された範囲で、技術文書やEU適合宣言書を当局に提示できる状態に保ち、当局の要請に協力します。
委任できない業務
設計・製造に関する義務と、技術文書の作成義務は委任できません（例：機械規則 第12条）。認定代理人は、あくまで製造業者の「代理」です。
市場監視規則第4条との関係
機械、低電圧機器、無線機器などの製品は、EU域内に責任を負う経済事業者（製造業者、輸入業者、認定代理人、またはフルフィルメントサービス事業者）がいなければ上市できません（市場監視規則 第4条）。域外の製造業者が輸入業者を介さずに販売する場合、認定代理人の指名が実務上ほぼ必須になります。
