§124 ノーティファイドボディの職員に関する要件
§124 — Requirements to personnel of notified body

4. 適合性評価機関、その最高経営層及び適合性評価業務の実施に責任を負う職員は、評価する昇降機又は昇降機用安全部品の設計者、製造業者、供給者、設置者、購入者、所有者、使用者若しくは保守者又はこれらの者の代理人であってはならない。
A conformity assessment body, its top level management and the personnel responsible for carrying out the conformity assessment tasks shall not be the designer, manufacturer, supplier, installer, purchaser, owner, user or maintainer of lifts or safety components for lifts which they assess, nor the representative of any of those parties.
これは、適合性評価機関の業務に必要な評価済みの昇降機若しくは昇降機用安全部品の使用、又は個人的目的のためのそのような昇降機若しくは昇降機用安全部品の使用を妨げるものではない。これは、製造業者又は設置者と機関との間の技術情報の交換の可能性を妨げるものではない。適合性評価機関、その最高経営層及び適合性評価業務の実施について責任を負う職員は、それらの昇降機若しくは昇降機用安全部品の設計、製造若しくは建設、販売、設置、使用若しくは保守に直接関与し、又はそれらの活動に従事する当事者を代表してはならない。これらの者は、届け出られた適合性評価活動に関する判断の独立性又は誠実性と抵触しうるいかなる活動にも従事してはならない。これは特にコンサルティングサービスに適用される。
This shall not preclude the use of assessed lifts or safety components for lifts that are necessary for the operations of the conformity assessment body or the use of such lifts or safety components for lifts for personal purposes. This does not preclude the possibility of exchange of technical information between the manufacturer or the installer and the body. A conformity assessment body, its top level management and the personnel responsible for carrying out the conformity assessment tasks shall not be directly involved in the design, manufacture or construction, the marketing, installation, use or maintenance of those lifts or safety components for lifts, or represent the parties engaged in those activities. They shall not engage in any activity that may conflict with their independence of judgement or integrity in relation to conformity assessment activities for which they are notified. This shall in particular apply to consultancy services.
適合性評価機関は、その子会社または下請け業者の活動が、適合性評価活動の機密性、客観性、または公平性に影響を与えないことを保証しなければならない。
A conformity assessment body shall ensure that the activities of its subsidiaries or subcontractors do not affect the confidentiality, objectivity or impartiality of its conformity assessment activities.
ノーティファイドボディは、製造業者、設置者、販売業者、輸入業者若しくは認定代理人、供給者若しくはそれらの商業上の競争者であってはならず、また、当該昇降機用安全部品及び昇降機の設計、設置、製造、販売又は保守に関してこれらの当事者のいずれかにコンサルティング若しくは助言を申し出、若しくは提供してはならない（又は申し出、若しくは提供したことがあってはならない。）。ただし、これは、製造業者、設置者、認定代理人、輸入業者又は販売業者とノーティファイドボディとの間の技術情報及び指針の交換の可能性を妨げるものではない。
A notified body may not be the manufacturer, installer, distributor, importer or authorised reprensative, a supplier or their commercial competitor, nor offer or provide (or have offered or provided) consultancy or advice to any of these parties as regards the design, installing, manufacturing marketing or maintenance of the safety components for lifts and the lifts in question. However, this does not preclude the possibility of exchanging technical information and guidance between the manufacturer, the installer, the authorised representative, the importer or the distributor and the notified body.
