§137 — Application for notification

1. 適合性評価機関は、設立されている加盟国の届出当局に届出の申請を提出しなければならない。
1. A conformity assessment body shall submit an application for notification to the notifying auhority of the Member State in which it is established.
2. ノーティフィケーションの申請には、適合性評価活動、適合性評価手続並びに当該機関が能力を有すると主張する昇降機又は昇降機用安全部品の説明、及び存在する場合には、当該適合性評価機関が第24条に定める要件を満たすことを証明する国家認定機関が発行した認定証明書を添付しなければならない。
2. The application for notification shall be accompanied by a description of the conformity assessment activities, the conformity assessment procedure or procedures and the lifts or safety components for lifts for which the body claims to be competent, as well as by an accreditation certificate, where one exists, issued by a national accreditation body attesting that the conformity assessment body fulfils the requirements laid down in Article 24.
3. 関係する適合性評価機関が認定証明書を提供できない場合、第24条に定める要件の遵守の確認、承認及び定期的な監視に必要なすべての文書による証拠を通知当局に提供しなければならない。
3. Where the conformity assessment body concerned cannot provide an accreditation certificate, it shall provide the notifying authority with all the documentary evidence necessary for the verification, recognition and regular monitoring of its compliance with the requirements laid down in Article 24.
決定No 768/2008/ECの新しい法的枠組みは、届出の申請に関するノーティファイドボディ及び国の当局の詳細な要件を定めている。
The New Legislative Framework from Decision No 768/2008/EC established detailed requirements for notified bodies and national authorities concerning the application for notification.
国家認定機関が発行する認定証は、適合性評価機関が指令2014/33/EU第24条に定める要件を満たしていることを証明する好ましい手段であることに留意することが重要である。この証明を伴わない認定証は、第28条第4項に従って扱われる。
It is important to note that the accreditation certificate, issued by a national accreditation body is the preferred means to attest that the conformity assessment body fulfils the requirements laid down in Article 24 of Directive 2014/33/EU. Accreditation certificates without this attestation are treated according to Article 28(4).
認定証を提出する適合性評価機関は、適合性評価活動、適合性評価手続、及び当該機関が能力を有すると主張する昇降機又は昇降機用安全部品の説明も提出しなければならない。
The conformity assessment body that provides an accreditation certificate must also provide a description of the conformity assessment activities, the conformity assessment procedure or procedures and the lifts or safety components for lifts for which the body claims to be competent.
さらに、認定機関は、適合性評価機関が第24条に定める要件を満たしていることを明示的に証明しなければならない。
Furthermore, the accreditation body must explicitly attest that the conformity assessment body fulfils the requirements laid down in Article 24.
