§118 — Status and use of ExNBG Clarification Sheets issued by the European ATEX Notified Bodies Group

ExNBG明確化シートは法的拘束力を有しないが、ノーティファイドボディによるATEX指令の技術的要件の解釈の相違を最小限にするために欧州ATEXノーティファイドボディグループ（ExNBG）が行う管理上の決定である。
ExNBG Clarification Sheets are not legally binding but are administrative decisions taken by the European ATEX Notified Bodies Group (ExNBG) in order to minimise divergent interpretation by notified bodies of the technical requirements of the ATEX Directive.
ATEX指令2014/34/EUの第21条第11項によれば、ExNBG明確化シートは、各ノーティファイドボディが一般的な指針として適用しなければならない。すなわち、原則には常に従わなければならず、決定の詳細は可能な限り実施しなければならない。これは、ノーティファイドボディが、技術の進歩又は「技術水準」に従い、調整に参加することにより、「最高度の技術的能力」を維持することを求められているためである。
According to Article 21(11) of the ATEX Directive 2014/34/EU, the ExNBG Clarification Sheets shall be applied as general guidance by each notified body i.e. the principle must always be followed and the details of the decision implemented as far as possible. This is because the notified bodies are required to keep "the highest degree of technical competence", by following the technical progress or the "state of the art" and participating in coordination.
その他の利害関係者にとって、ExNBG明確化シートは、ノーティファイドボディの有資格の代表者による技術の進歩又は「技術水準」に関する「専門家の意見」として、指令の実務上の適用に関する任意の指針とみなすべきである。言い換えれば、ExNBG明確化シートは、機械、昇降機、個人用保護具など他の整合法令の下でノーティファイドボディの欧州調整グループが発行する「使用のための勧告シート」と同じレベルの、有用な実務上の勧告とみなすことができる。
For other interested parties, ExNBG Clarification Sheets should be considered as voluntary guidance to the practical application of the Directive, as an "expert opinion" related to the technical progress or the "state of the art", coming from qualified representatives of notified bodies. In other words, ExNBG Clarification Sheets could be regarded as useful practical recommendations, at the same level of "Recommendation for Use Sheets" issued by European co-ordinations of notified bodies under other harmonisation legislation such as such as Machinery, Lifts, Personal Protective Equipment, etc.
いずれの場合も、ExNBG明確化シートの使用は、ATEX指令2014/34/EUの健康及び安全の要件に関する証明とみなすことはできない。指令の必須要件への適合の推定を与えるのは欧州整合規格であり、ExNBG明確化シートではない。
In any case, the use of ExNBG Clarification Sheets cannot be considered a proof concerning health and safety requirements of the ATEX Directive 2014/34/EU. European harmonised standards give presumption of conformity with the essential requirements of the directive, but not ExNBG Clarification Sheets.
ExNBG明確化シートは、ノーティファイドボディだけでなく製造業者その他の利害関係者にも専門家による解釈の指針を提供する上での重要性及び有用性を認め、ATEX委員会又は専門家グループがガイダンス文書として承認し又は「留意」することができる。「留意」の手続は、ATEX専門家グループが、CIRCABC上の関連する関心グループを介した「書面手続」により、又は委員会メンバーの要請に応じて（コメント、意見等を提出することにより）専門家グループ会合における「口頭手続」を用いて行う。
ExNBG Clarification Sheets can be endorsed or "noted" by the ATEX Committee or Expert Group as guidance documents, by recognising their importance and utility in order to provide expert interpretation guidance, not only to notified bodies, but also to manufacturers and other interested parties. The "noting" process is carried out by the ATEX Expert Group though a "Written Procedure" via the relevant Interest Group on CIRCABC or, at request of Committee Members (by introducing comments, remarks etc.), by using an "Oral Procedure" at the Expert Group meetings.

"Noted" ExNBG Clarification Sheets, as such, are made publicly available on the Commission website on: https://ec.europa.eu/docsroom/documents/54514.
ATEX委員会又は専門家グループにより留意されていないが、ExNBGの作業に必要な明確化シートは、ExNBGに関するCIRCABCのウェブページで入手できる。特定のExNBG明確化シートの内容は、ATEX委員会又は専門家グループの「検討文書」により異議を唱えられ、及び／又はATEXガイドラインに含められることがある。この場合、ExNBGは関連する明確化シートを撤回する。
Those Clarification Sheets, which are not noted by the ATEX Committee or Expert Group but which are needed for the work of ExNBG, are available on the CIRCABC webpage related to ExNBG. The content of specific ExNBG Clarification Sheets could be challenged by a "Consideration Paper" by the ATEX Committee or Expert Group and/or to be included into the ATEX Guidelines. In this case, the ExNBG withdraws the relevant Clarification Sheets.
いずれの場合も、ExNBG明確化シートをその目的及び範囲に従い、上記の考慮事項を十分に考慮してノーティファイドボディが使用するために、ATEX委員会又は専門家グループによる「留意」は必要でないことに注意することが重要である。
It is important to remark that, in any case, "noting" by the ATEX Committee or Expert Group is not necessary for an ExNBG Clarification Sheet to be used by the notified bodies, according to its purpose and scope, and taking into due account the above considerations.
