ATEX指令2014/34/EUの法的根拠は、欧州連合運営条約（TFEU）第114条（旧EC条約第95条）であり、同条は、単一域内市場の確立及び機能を確保するために、欧州連合が加盟国の法令を調和させる措置を採択することを可能にしている。このような措置は、人の健康及び安全並びに環境の保護について可能な限り高い水準を基礎としなければならない。したがって、指令は二重の目的、すなわち、健康及び安全の高い水準の保護を確保しつつ、域内市場における製品の自由な移動を可能にすることを目的としている。

The legal basis of the ATEX Directive 2014/34/EU is provided by Article 114 of the Treaty on the Functioning of the European Union (TFEU) (ex-Article 95 of the EC Treaty) that enables the European Union to adopt measures to harmonise the legislation of the Member States in order to ensure the establishment and functioning of the single internal market. Such measures must take as a basis the highest possible level of protection of the health and safety of people and of the environment. The Directive thus has a dual objective: to permit the free movement of products with the internal market whilst ensuring a high level of protection of health and safety.

欧州委員会の提案を受けて、指令は、欧州経済社会評議会への諮問の後、TFEU第294条に定める通常立法手続（旧「共同決定」）に従い、欧州議会及び欧州連合理事会により採択された。

Following the proposal by the European Commission, the Directive was adopted by the European Parliament and the Council of the European Union after consulting the European Economic and Social Committee, according to the ordinary legislative procedure (formerly known as "co-decision") set out in Article 294 of the TFEU.
