第89条 委任の行使
Article 89 — Exercise of the delegation
1. 委任法令を採択する権限は、本条に定める条件に従って欧州委員会に付与される。
1. The power to adopt delegated acts is conferred on the Commission subject to the conditions laid down in this Article.
2. 第6条(2)、第7条(1)、(2)及び(3)、第8条(1)及び(5)、第9条(2)、第10条(5)及び(6)、第11条(4)、第12条(3)、第13条(8)、第14条(4)、第48条(8)、第53条(3)、第59条(7)、第60条(8)、第70条(4)、第71条(4)、(5)及び(6)、第72条(4)、第77条(2)及び(3)並びに第85条(3)に規定する委任法令を採択する権限は、2023年8月17日から5年間、欧州委員会に付与される。欧州委員会は、5年の期間の終了の遅くとも9か月前までに、権限の委任に関する報告書を作成しなければならない。権限の委任は、欧州議会又は理事会が各期間の終了の遅くとも3か月前までに当該延長に反対しない限り、同一の期間について黙示的に延長される。
2. The power to adopt delegated acts referred to in Article 6(2), Article 7(1), (2) and (3), Article 8(1) and (5), Article 9(2), Article 10(5) and (6), Article 11(4), Article 12(3), Article 13(8), Article 14(4), Article 48(8), Article 53(3), Article 59(7), Article 60(8), Article 70(4), Article 71(4), (5) and (6), Article 72(4), Article 77(2) and (3), and Article 85(3) shall be conferred on the Commission for a period of five years from 17 August 2023. The Commission shall draw up a report in respect of the delegation of power no later than nine months before the end of the five-year period. The delegation of power shall be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes such extension no later than three months before the end of each period.
3. 第6条(2)、第7条(1)、(2)及び(3)、第8条(1)及び(5)、第9条(2)、第10条(5)及び(6)、第11条(4)、第12条(3)、第13条(8)、第14条(4)、第48条(8)、第53条(3)、第59条(7)、第60条(8)、第70条(4)、第71条(4)、(5)及び(6)、第72条(4)、第77条(2)及び(3)並びに第85条(3)に規定する権限の委任は、欧州議会又は理事会によりいつでも取り消すことができる。取消しの決定は、当該決定に特定された権限の委任を終了させる。当該決定は、欧州連合官報への公表の翌日又はそこに特定されたそれより後の日に効力を生じる。当該決定は、すでに発効している委任法令の有効性に影響を及ぼさない。
3. The delegation of power referred to in Article 6(2), Article 7(1), (2) and (3), Article 8(1) and(5), Article 9(2), Article 10(5) and (6), Article 11(4), Article 12(3), Article 13(8), Article 14(4), Article 48(8), Article 53(3), Article 59(7), Article 60(8), Article 70(4), Article 71(4), (5) and (6), Article 72(4), Article 77(2) and (3), and Article 85(3) may be revoked at any time by the European Parliament or by the Council. A decision to revoke shall put an end to the delegation of the power specified in that decision. It shall take effect the day following the publication of the decision in the Official Journal of the European Union or at a later date specified therein. It shall not affect the validity of any delegated acts already in force.
4. 委任法を採択する前に、委員会は、2016年4月13日のより良い立法に関する機関間協定に定められた原則に従って、各加盟国が指名した専門家と協議しなければならない。
4. Before adopting a delegated act, the Commission shall consult experts designated by each Member State in accordance with the principles laid down in the Interinstitutional Agreement of 13 April 2016 on Better Law-Making.
5. 欧州委員会は、委任法令を採択した場合、直ちに欧州議会及び理事会に同時に通知しなければならない。
5. As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.
6. 第6条(2)、第7条(1)、(2)及び(3)、第8条(1)及び(5)、第9条(2)、第10条(5)及び(6)、第11条(4)、第12条(3)、第13条(8)、第14条(4)、第48条(8)、第53条(3)、第59条(7)、第60条(8)、第70条(4)、第71条(4)、(5)及び(6)、第72条(4)、第77条(2)及び(3)又は第85条(3)に従い採択された委任法令は、当該法令の欧州議会及び理事会への通知から3か月の期間内に欧州議会若しくは理事会のいずれからも異議が表明されなかった場合、又は当該期間の満了前に欧州議会及び理事会の双方が異議を唱えない旨を欧州委員会に知らせた場合にのみ発効する。当該期間は、欧州議会又は理事会の発意により2か月延長される。
6. A delegated act adopted pursuant to Article 6(2), Article 7(1), (2) and (3), Article 8(1) and (5), Article 9(2), Article 10(5) and(6), Article 11(4), Article 12(3), Article 13(8), Article 14(4), Article 48(8), Article 53(3), Article 59(7), Article 60(8), Article 70(4), Article 71(4), (5) and (6), Article 72(4), Article 77(2) and (3), or 85(3) shall enter into force only if no objection has been expressed either by the European Parliament or the Council within a period of three months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object. That period shall be extended by two months at the initiative of the European Parliament or of the Council.
