Union harmonisation legislation defines the manufacturer, the authorised representative, the importer, the fulfilment service provider and the distributor as ‘economic operators’. The main responsibility is put on the manufacturer.
The other operators have their obligations build on those of the manufacturer.
Therefore, this section firstly describes these economic operators and then concentrates on the specific obligations of the manufacturer.
Before placing radio equipment on the EU market, economic operators shall ensure that the appropriate conformity assessment procedure has been carried out by the manufacturer. They shall ensure that the radio equipment manufacturer has drawn up the EU-DoC and the radio equipment is accompanied by instructions and safety information and bears the CE marking, see sections 2.3 to 2.5.
Whether an economic operator places radio equipment on the EU market under his own name or trademark or modifies radio equipment already placed on the EU market in such a way that compliance with this Directive is impacted, the economic operator has to take over the obligations as the manufacturer of the RE.
Regulation (EU) 2019/1020 requires in its Article 4 that there must be an economic operator established in the EU (manufacturer, importer, authorized representative, or fulfilment service provider) shall provide information to market surveillance authorities and cooperate with them.
