10.9.1 — General Data Protection Regulation 2016/679 (GDPR)
欧州委員会が公表する公式ガイダンス2026年7月7日版の参考訳です。ガイドは法的拘束力を持たず、疑義がある場合は英語版が基準となります。色付きの枠は指令本文の引用、それ以外が欧州委員会の解説です。
GDPRはプロセス（事後）、すなわちデータがどのように管理されるかに関するものであり、データ管理者、処理者などに要件／義務を課している。製品の市場アクセスには関係しない。
GDPR is about the process (ex-post), i.e. how the data are managed, by imposing requirements/obligations on data controllers, processors, etc. It does not concern market access of products.
他方、REDは、EU市場への上市の時点における製品の適合（事前）に関するものである。また、適用される要件に適合しない製品をEU市場から回収するための手続も定めている。REDには、（EU）2022/30及び（EU）2023/2444により2025年8月1日から適用されるサイバーセキュリティ（詐欺、個人データ、プライバシー）に関する要素も含まれており、これにより当該製品が必要な技術的解決策を組み込むことが確保され、GDPRの適正な機能を補完することになる。
On the other hand, the RED is about the compliance of products at the time of their placing on the EU market (ex-ante). It also provides procedures for withdrawing products from the EU market when they do not comply with the applicable requirements. RED includes also elements related to cybersecurity (fraud, personal data, privacy) which will be applicable from 1 August 2025 (EU) 2022/30 & (EU) 2023/2444 which will ensure that the products in question incorporate the necessary technical solutions and will thus supplement the proper functioning of the GDPR.
