The RED covers radio equipment which are new to the Union market when placed on the market (either new products made by a manufacturer established in the Union or products, whether new or second-hand, imported from a third country).
ブルーガイド第2.1章によれば、上市／使用開始された後に重要な変更又は分解修理を受けた製品は、新たな製品とみなさなければならない。
According to Chapter 2.1 of the Blue Guide, a product which has been subject to important changes or overhaul after it has been plac ed on the market/put into service must be considered as a new product.
一般に、無線機器のソフトウェア更新又は修理は、適用される要件への適合に影響を及ぼしうる形で既に上市された製品を変更するものでない限り、保守作業と同等とみなすことができる。
Generally, software updates or repairs of radio equipment could be assimilated to maintenance operations provided that they do not modify a product already placed on the market in such a way that compliance with the applicable requirements may be affected.
物理的な修理又は変更の場合と同様に、次の場合には、製品はソフトウェアの変更により大幅に変更されたとみなされるべきである。
As is the case for physical repairs or modifications, a product should be considered as substantially modified by a software change where:
(a) ソフトウェア更新が、製品の当初の意図された機能、無線インタフェース、型式又は性能を変更し、それが当初のリスクアセスメントで予見されていなかったこと。
(a) the software update modifies the original intended functions, radio interface, type or performance of the product and this was not foreseen in the initial risk assessment.
(b) ソフトウェア更新により危害の性質が変化し、又はリスクの水準が上昇したこと。及び (c) 製品が提供されること。
(b) the nature of the hazard has changed, or the level of risk has increased because of the software update; and (c) the product is made available.
