2.4 — Authorised representative

製造業者は、書面による委任により、自らに代わってその責任の一部を遂行するEU域内に設立された認定代理人を任命することができる。RED第11条は、認定代理人が満たすべき要件を記述している。

A manufacturer may, by a written mandate, appoint an authorised representative established in the EU to carry out some of his responsibilities on his behalf. Article 11 of the RED describes the requirements to be met by the authorised representative.

REDは、製造業者が複数の認定代理人を指定することを妨げていないが、製造業者に代わって行動するよう製造業者が指定したすべての認定代理人は、RED第11条の規定を満たさなければならず、委任は少なくとも同条第2項に定める業務を対象としなければならない。

The RED does not prevent the manufacturer from designating more than one authorised representative, however all authorized representatives designated by the manufacturer to act on the manufacturer’s behalf shall meet the provisions of Article 11 RED and the mandate must cover as a minimum the tasks specified in point 2 of that Article.

各認定代理人の業務は、委任において明確に特定しなければならない（業務は、例えば各認定代理人が設立されている場所（加盟国）、又は当該製品に適用される同一の連合法令若しくは異なる連合法令から生ずる異なる業務にもとづいて割り当てることができる。）。

The tasks for each autorised representative must be clearly specified in the mandate (the task can be allocated for example on the basis of the place, Member State, where each autorised representative is established or the basis of different tasks that stem from the same Union act or from different Union acts applicable to the product in question).

複数の者に割り当てることができず、連合法令が明示的又は黙示的に単一の者が行うことを求める業務（例えばEU適合宣言書への署名、又は規則2019/1020 第4条にもとづく責任ある経済事業者となること）は、単一の認定代理人に割り当てなければならない。

Tasks that cannot be allocated to several persons and the Union legislation requires, explicitly or impliedly, to be carried out by a single person (example signing the EU-DoC or being the responsible economic operator under Article 4 of Regulation 2019/1020), shall be allocated to a single authorised representative.

本ガイドの第2.8.a)節、第2.8.b)節及び第2.8.d)節に記述する製造業者の義務は、認定代理人の委任の一部としてはならない。

The manufacturer obligations described in sections 2.8.a), 2.8.b) and 2.8.d) of this Guide shall not be part of the authorised representative’s mandate.

認定代理人の委任には、少なくとも次の事項を含めなければならない。

The authorised representative’s mandate shall at least contain the following:

（EU適合宣言書及び技術文書を）無線機器のEU市場への上市後10年間、市場監視当局の利用に供すること。

surveillance authorities for 10 years after the radio equipment has been placed on the EU market;

REDの下で委任が特定すべき最低限の業務は、連合域内に設立された経済事業者を置くという要件を満たすために規則（EU）2019/1020 第4条を遵守するには不十分である。

The minimum set of tasks that the mandate should specify under the RED is insufficient to comply with article 4 (EU) 2019/1020 to fulfill the requirement to have a economic operator established in the Union.
