10.9.2 — E-privacy Legislation
欧州委員会が公表する公式ガイダンス2026年7月7日版の参考訳です。ガイドは法的拘束力を持たず、疑義がある場合は英語版が基準となります。色付きの枠は指令本文の引用、それ以外が欧州委員会の解説です。
これはGDPRに対する特別法であり、GDPRを具体化し補完することを目的としている。GDPRと同様に、製品の市場アクセスには関係しない。
It is a lex specialis to the GDPR, as it aims at particularizing and complementing the latter. Like the GDPR, it does not concern market access of products.
他方、REDは、EU市場への上市の時点における製品の適合（事前）に関するものであり、不適合な製品をEU市場から回収するための手続も定めている。上記のGDPRを参照のこと。
On the other hand, the RED is about the compliance of products at the time of their placing on the EU market (ex-ante) and provide also procedures for withdrawing non-compliant products from the EU market. See GDPR (above)
