1.7.2 — What is internet connected radio equipment or wearable radio equipment (for the purposes of applicability of the essential requirements of the RED relating to cybersecurity)?

Radio equipment could be also classified as internet connected or wearable radio equipment, under Commission Delegated Regulation (EU) 2022/30 of 29 October 2021, supplementing the RED, with regard to the application of the essential requirements referred to in Article 3(3), points (d), (e) and (f), of the RED (essential requirements of the RED relating to cybersecurity).
With ‘internet-connected radio equipment’, it is meant radio equipment that can communicate itself over the internet, whether it communicates directly or via any other equipment. Section 12.1 to this Guide provides some guidance to the assessor to define if the radio equipment is ‘internet-connected’, which is relevant for the applicability of of Article 3(3) (d)-(f) of the RED, due to the terms used in Commission Delegated Regulation (EU) 2022/30.
With ‘wearable radio equipment’, it is meant radio equipment that is designed or intended, whether exclusively or not exclusively, to be worn on, strapped to, or hung from any part of the human body (including the head, neck, trunk, arms, hands, legs and feet) or any clothing (including headwear, hand wear and footwear) worn by human beings such as radio equipment in the form of wrist watch, ring, wristband, headset, earphone or glasses. However, this is limited to the portable devices that are used for monitoring and registering sensitive data (e.g. fitness trackers, smart watches, smart rings, etc.), thus rather used in close distance to the human body and not to any other equipment that can be hung around the neck or strapped around the hand- (e.g Cameras, etc.). Radio equipment solely used in the hand (e.g smartphones, etc.), is not covered by the meaning of wearable.
Moreover, implants should not be considered as wearable radio equipment as they are not worn on, strapped to, or hung from any part of the human body or any clothing.
Implants should be deemed to be ‘internet-connected radio equipment’, if they are capable themselves to communicate over the internet, regardless if they communicate directly or via any other equipment.
