§25 — Obligations of manufacturers for importers and distributors

Article 10 Cases in which obligations of manufacturers apply to importers and distributors

An importer or distributor shall be considered a manufacturer for the purposes of this
Directive and he shall be subject to the obligations of the manufacturer under Article 6, where he places electrical equipment on the market under his name or trade mark or modifies electrical equipment already placed on the market in such a way that compliance with this Directive may be affected.
製造業者以外の経済事業者、すなわち、自己の名称若しくは商標で電気機器を上市し、又はLVDへの適合に影響を及ぼしうる形で電気機器を変更する（したがって新たな製品を生み出す）輸入業者又は販売業者は、製造業者とみなされ、製品の適合性及びCEマーキングの貼付の責任を含め、製造業者の義務を負うべきである。
An economic operator other than the manufacturer, i.e. an importer or the distributor that either places electrical equipment on the market under his own name or trade mark or modifies electrical equipment in such a way (thus creating a new product) that compliance with the LVD may be affected, he is considered to be the manufacturer and should assume the obligations of the manufacturer, including the responsibility for the conformity of the product and the affixing of the CE marking.
製品の変更、及び製造業者とは異なる商号又はブランド名で販売される製品についての指針を示している「ブルーガイド（EU製品規則の実施に関するガイド）」第3.1章「製造業者」及び第2.1章「製品の対象範囲」を参照のこと。

経済事業者が製造業者の責任を引き受ける場合には、適合宣言書（DoC）を差し替え／更新（自己の名称を記入し署名）しなければならない。この義務は、その他の証明書、文書などには及ばない。ただし、経済事業者が製造業者の責任を引き受ける場合には、これらすべての文書を含め、LVDへの適合について全面的な責任を負うことになる。
If an economic operator undertakes the responsibilities of the manufacturer, he shall replace/update the DoC (insert his name and sign it). This obligation does not extend to the other certificates, documents etc. However, where an economic operator undertakes the responsibilities of the manufacturer, he is assuming full responsibility for the compliance with the LVD, including of all these documents.
