Some types of electrical equipment covered by the LVD are manufactured with a view to being permanently incorporated in construction works. Consequently, such equipment must also conform to the obligations imposed by the Construction Products Regulation (EU) No 305/2011. Most importantly, products covered by harmonised standards under Regulation (EU) No 305/2011 have to be assessed in conformity with the applicable standards and be accompanied by a declaration of performance and the CE mark.
As a result, application to such electrical equipment of the provisions of the "Construction Products" Regulation presupposes the existence of both harmonised standards (or alternatively, applicable European Assessment Documents) within the meaning of the “Construction Products” Regulation and decisions concerning the conformity assessment procedures, again within the meaning of that Regulation. Should these essential conditions not be met, the provisions of Regulation (EU) No 305/2011 cannot in practice be applied to the relevant electrical equipment.
However, the LVD sets a wide range of safety objectives, overlapping with essential requirements in Annex I to Regulation (EU) No 305/2011. In order to best ensure the objectives of both pieces of EU legislation, existing harmonised standards (as published under the LVD) are being examined in order to ensure that they are also consistent with the relevant essential requirements of the "Construction Products" Regulation.
