§28 — Presumption of conformity on the basis of harmonised standards

Presumption of conformity on the basis of harmonised standards
Electrical equipment which is in conformity with harmonised standards or parts thereof the references of which have been published in the Official Journal of the European Union shall be presumed to be in conformity with the safety objectives referred to in Article 3 and set out in Annex I covered by those standards or parts thereof.
製品の適合の推定は、規則（EU）No 1025/2012に従って採択された欧州整合規格であって、その参照が欧州連合官報（OJEU）に公表されたものを使用することにより与えられる。
The presumption of conformity of products is conferred by the use of European harmonised standards adopted in accordance with Regulation (EU) No 1025/2012 if their reference is published in the Official Journal of the European Union (OJEU).
この点に関し、欧州委員会は、LVDを考慮するようCEN、CENELEC及びETSIに一般的な標準化委任（マンデート）を発出した。特に、LVD附属書Iに示す安全目標を支えるため、一定の電圧範囲内で使用するよう設計された電気機器のための任意の整合規格を採択し提供することである。この委任は、旧指令2006/95/ECの下で既に採択された既存の整合規格の改訂、修正、廃止又は置換えも対象としている。
In this regard, the Commission issued a general Mandate to CEN, CENELEC and ETSI to take account of the LVD. In particular, to adopt and provide voluntary harmonised standards for electrical equipment designed for used within certain voltage limits in support of safety objectives given in the Annex I of the LVD. This Mandate covers also revision, amendment, repeal or replace of any existing harmonised standards already adopted under the old Directive 2006/95/EC.
旧LVDと異なり、LVD 2014/35/EUの下では、適合の推定は整合規格の参照がOJEUに公表された場合にのみ与えられ、整合規格それ自体に限定される。整合規格に関する指針文書（例：OSM決定）は、適合の推定を与えない。
Unlike the old LVD, under the LVD 2014/35/EU, the presumption of conformity is only conferred when the reference of the harmonised standard is published in the OJEU and it is restricted to the harmonised standard itself. Guidance documents on harmonised standards (e.g. OSM decisions) do not confer the presumption of conformity.
前文第16項に示すとおり、LVDは、連合市場に上市される電気機器が満たさなければならない強制的な安全目標を定めている。欧州整合規格は、これらの安全目標に適合するための詳細な技術的解決策を提供する。整合規格を適用する製造業者は、それが対象とする安全目標への適合の推定の恩恵を受けることができるが、整合規格の使用は引き続き任意である。
As indicated in Recital 16, the LVD sets out the mandatory safety objectives that electrical equipment placed on the Union market must fulfil. European harmonised standards provide detailed technical solutions for complying with these safety objectives. Manufacturers applying harmonised standards can benefit from presumption of conformity with the safety objectives they cover, however the use of harmonised standards remains voluntary.
官報には、置き換えられた規格の適合の推定の終了日も記載される。これは、技術の進歩及び安全に関する適正な工学的慣行の発展に照らして、整合規格がもはや最新とはみなされなくなる日とみなされる（第3条）。
The Official Journal also contains the date of cessation of presumption of conformity of the superseded standard, which is considered to be the date beyond which a harmonised standard is no longer considered to be up to date in the light of technological progress and the developments in good engineering practice in safety matters (Article 3).
前文第17項は、標準化規則（EU）No 1025/2012が、整合規格がそれが対象とすることを目指す安全目標を完全には満たしていないと加盟国又は欧州議会が判断する場合に、当該整合規格に異議を唱えるための「正式異議」手続を定めていることを説明している。
Recital 17 explains that Standardisation Regulation (EU) No 1025/2012 provides for a "formal objection" procedure for disputing a harmonised standard that is considered by a Member State or by the European Parliament that it does not entirely satisfy the safety objectives which it aims to cover.
