第47条 委任の行使
Article 47 — Exercise of the delegation

1. 委任法を採択する権限は、本条に定める条件に従って欧州委員会に付与される。
1. The power to adopt delegated acts is conferred on the Commission subject to the conditions laid down in this Article.
2. 第6条第2項、第6条第11項及び第7条第2項に規定する委任法を採択する権限は、2023年7月19日から5年間、欧州委員会に付与される。欧州委員会は、5年の期間の終了の遅くとも9か月前までに、権限の委任に関する報告書を作成しなければならない。権限の委任は、欧州議会又は理事会が各期間の終了の遅くとも3か月前までに延長に反対しない限り、同一期間ずつ黙示的に延長される。
2. The power to adopt delegated acts referred to in Articles 6(2), 6(11) and 7(2) shall be conferred on the Commission for a period of five years from 19 July 2023. The Commission shall draw up a report in respect of the delegation of power not later than nine months before the end of the five-year period. The delegation of power shall be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes such extension not later than three months before the end of each period.
3. 第6条第2項、第6条第11項及び第7条第2項に規定する権限の委任は、欧州議会又は理事会がいつでも撤回することができる。撤回の決定は、当該決定で特定された権限の委任を終了させる。当該決定は、欧州連合官報での決定の公表の翌日又はそこで定める後日に効力を生ずる。当該決定は、すでに発効している委任法の有効性に影響しない。
3. The delegation of power referred to in Articles 6(2), 6(11) and 7(2) may be revoked at any time by the European Parliament or by the Council. A decision to revoke shall put an end to the delegation of the power specified in that decision. It shall take effect the day following the publication of the decision in the Official Journal of the European Union or at a later date specified therein. It shall not affect the validity of any delegated acts already in force.
4. 委任法を採択する前に、欧州委員会は、2016年4月13日のより良い法定立に関する機関間協定に定める原則に従い、各加盟国が指名した専門家と協議しなければならない。
4. Before adopting a delegated act, the Commission shall consult experts designated by each Member State in accordance with the principles laid down in the Interinstitutional Agreement of 13 April 2016 on Better Law-Making.
5. 委任法を採択したときは直ちに、欧州委員会は、欧州議会及び理事会に同時にこれを通知しなければならない。
5. As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.
6. 第6条第2項、第6条第11項又は第7条第2項に従って採択された委任法は、欧州議会及び理事会に当該委任法が通知されてから2か月以内に欧州議会又は理事会のいずれからも異議が表明されなかった場合、又は当該期間の満了前に欧州議会及び理事会の双方が異議を述べない旨を欧州委員会に通知した場合に限り、発効する。当該期間は、欧州議会又は理事会の発議により2か月延長される。
6. A delegated act adopted pursuant to Articles 6(2), 6(11) or 7(2) shall enter into force only if no objection has been expressed either by the European Parliament or by the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object. That period shall be extended by two months at the initiative of the European Parliament or of the Council.
