The purpose of market surveillance is to ensure that the provisions of the EMCD are complied with across the Union. Consumers, workers and other users are entitled to an equivalent level of EMC protection throughout the single market, regardless of the origin of the product. Further, market surveillance is important for interests of economic operators, because it helps to eliminate unfair competition.
Member States are required to take all appropriate measures to ensure that equipment is placed on the market and/or put into service only if it complies with the requirements of the EMCD, when properly installed, maintained and used for its intended purpose.
This obligation is complementary to that requiring Member States to allow free movement of equipment that is in compliance with the EMCD.
