7.3 — Subcontracting

ノーティファイドボディは、下請業者又は子会社もEMCD第24条に定める要件を満たすことを条件として、限定された特定の適合性評価業務を下請に出し、又は子会社を利用することができる。ノーティファイドボディはその旨を届出当局に通知しなければならず、下請業者又は子会社が実施する活動については顧客の同意を得なければならない。ノーティファイドボディは、下請業者又は子会社が実施した業務について全面的な責任を負い続ける。
The Notified Body can subcontract limited specific conformity assessment tasks or have recourse to a subsidiary, provided that the subcontractor or subsidiary also meets the requirements set out in Article 24 of the EMCD. Notified bodies shall inform the notifying authority accordingly, and agreement of the client must be obtained for activities to be performed by the subcontractor or subsidiary. The notified body remains fully responsible for the tasks performed by the subcontractor or the subsidiary.
したがって、下請は権限又は責任の委任を伴わない。
Subcontracting does not therefore entail the delegation of powers or responsibilities.
ノーティファイドボディの決定は、常にノーティファイドボディの名において、その責任の下でのみ発せられる（ブルーガイド第5.2.5節「ノーティファイドボディによる下請」を参照）。
Notified Body decisions are always solely issued in the name and under the responsibility of the Notified Body (see section 5.2.5 of the Blue Guide "Subcontracting by notified bodies").
