第21条 委員会手続
Article 21 — Committee procedure
1. 欧州委員会は、指令2008/98/EC第39条により設置された委員会の補佐を受ける。当該委員会は、規則(EU) No 182/2011の意味における委員会とする。
1. The Commission shall be assisted by the Committee established by Article 39 of Directive 2008/98/EC. That committee shall be a committee within the meaning of Regulation (EU) No 182/2011.
2. 本項が参照される場合、規則(EU) No 182/2011第5条を適用する。
2. Where reference is made to this paragraph, Article 5 of Regulation (EU) No 182/2011 shall apply.
委員会が意見を述べない場合には、欧州委員会は実施法案を採択してはならず、規則(EU) No 182/2011第5条(4)第3段落が適用される。
Where the committee delivers no opinion, the Commission shall not adopt the draft implementing act and the third subparagraph of Article 5(4) of Regulation (EU) No 182/2011 shall apply.
