第44条 国内法化
Article 44 — Transposition
1. 加盟国は、2016年4月19日までに、第2条(2)、第3条(1)第(9)号から第(25)号まで、第4条、第5条(1)、第7条から第12条まで、第15条、第16条及び第17条、第19条(1)第1段落、第20条から第43条まで並びに附属書II、III及びIVを遵守するために必要な法律、規則及び行政規定を採択し、公表しなければならない。加盟国は、直ちに当該措置の本文を欧州委員会に通知しなければならない。
1. Member States shall adopt and publish, by 19 April 2016, the laws, regulations and administrative provisions necessary to comply with Article 2(2), points (9) to (25) of Article 3(1), Article 4, Article 5(1), Articles 7 to 12, Articles 15, 16 and 17, the first subparagraph of Article 19(1), Articles 20 to 43, and Annexes II, III and IV. They shall forthwith communicate the text of those measures to the Commission.
加盟国は、2016年4月20日から当該措置を適用しなければならない。
They shall apply those measures from 20 April 2016.
加盟国が当該措置を採択する場合、当該措置は本指令への言及を含み、又はその公式な公表の際に当該言及を伴わなければならない。当該措置にはまた、本指令により廃止される指令への既存の法律、規則及び行政規定における言及は本指令への言及と解釈される旨の記載を含めなければならない。加盟国は、当該言及を行う方法及び当該記載の文言を定めなければならない。
When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. They shall also include a statement that references in existing laws, regulations and administrative provisions to the Directive repealed by this Directive shall be construed as references to this Directive. Member States shall determine how such reference is to be made and how that statement is to be formulated.
2. 加盟国は、本指令の対象となる分野において採択する国内法の主要な規定の本文を欧州委員会に通知しなければならない。
2. Member States shall communicate to the Commission the texts of the main provisions of national law which they adopt in the field covered by this Directive.
